Hoagyweb Hosting is a subsiduary of Hoagyweb and will be referred to as HWH.

HWH reserve the right to suspend an account if these terms are breached.

HWH will register a domain on completion of the relevant order form by the client.

UK domains are issued subject to the Terms & Conditions of the registrars Nominet.

HWH will provide confidentiality & will not forward any information provided by client to ANY third party.

"Free" co.uk domains offered with plans must be paid for "up front" and the cost will be deducted from any plan ordered.

Once an order is placed it can not be cancelled unless an e-mail is received at HWH Sales prior to HWH processing the order.

Once a plan/domain is ordered HWH will mail an Invoice to the applicant. Payment must be made within 30 days of the invoice date. HWH cannot guarantee continuance of service if the Invoice is not paid within 30 days. HWH own the rights to the domain name until the invoice has been paid in full.

Renewal notices will be sent at least 14 days prior to renewal.

Payments must be received prior to renewal date.

If payment is not made then HWH will take steps to recover the debt and the applicant will be liable to all Court fees / Debt Collection fees together with Interest on the outstanding amount as covered under Late Payment of Commercial Debts [Interest] Act 1998.

We make no charge if you wish to transfer your domain away from HWH on condition that all outstanding Invoices have been paid in full.

HWH do not place ANY banners or adverts on your site.

HWH reserves the right to refuse service and/or access to its servers to anyone at any time.

HWH do not allow any of the following content to be stored on its servers: Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation. Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of HWH. Content relating to Hacking, Cracking, Warez or IRC is not allowed.

Any file you store on our Servers will be reachable via a hyperlink from a page on your site.

The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.

Illegality in any form is not permitted. Only software, audio or video for which you are the writer and copyright holder may be hosted.

Publishing to the Internet is the same as publishing and distributing a paper document and subject to the same rules. Common sense is the best guide but if in any doubt then ask!

Resources are defined as bandwidth and/or processor utilization and/or hard drive utilization. HWH may implement the following policy to its sole discretion: When a website is found to be monopolising the resources available HWH reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers or where one domain is using a disproportionate amount of bandwidth compared to the majority of other domains.

In any case usage exceeding the monthly allowance will be charged at the following rates. Usage exceeding the limit by less than 1000 Mb will be charged at £0.03 for every Mb over the limit. Usage of 1000 Mb or more over the limit will be charged at £0.02 p for every Mb over the monthly limit. The 3000Mb allowances were introduced on the 12th April 2004 for all new accounts on SGN - W2K1, W3K1 & LINUX1 Plans.

HWH will not be responsible for any damages your business may suffer. HWH makes no warranties of any kind, expressed or implied for services we provide. HWH disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by HWH and its employees / servants. HWH reserves the right to revise its policies at any time.
